These trademarks are used to distinguish HARDEE’S's quality products and services. "HARDEE’S Trademarks" means all names, marks, brands, logos, designs, trade dress, slogans and other designations HARDEE’S uses in connection with its products and services. You may not remove or alter any HARDEE’S Trademarks, or co-brand your own products or material with HARDEE’S Trademarks without HARDEE’S's prior written consent. You acknowledge HARDEE’S's rights in HARDEE’S Trademarks and agree that any use of HARDEE’S Trademarks by you shall inure to HARDEE’S's sole benefit. 5. You may not share or transfer password or other access information with any other party, temporarily or permanently. You shall bear sole responsibility for all use of any account you have been permitted to create on this Site and for the confidentiality of your password.

HARDEE’S does not necessarily monitor any materials posted, transmitted or communicated to or within the Site. The above terms do not apply to any ideas or other no protectable information you may submit to HARDEE’S, which ideas will be governed by the "Communicating with HARDEE’S" section above.

Website Access

1. HARDEE’S hereby grants you permission to use the Site as set forth in this Terms of Use, provided that: (i) your use of the Site as permitted is solely for your personal, noncommercial use; (ii) you will not copy or distribute any part of the Site in any medium without HARDEE’S's prior written authorization; (iii) you will not alter or modify any part of the Site other than as may be reasonably necessary to use the Site for its intended purpose; and (iv) you will otherwise comply with the terms and conditions of these Terms of Use.
2. In order to access some features of the Site, you will have to create an account. You may never use another's account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify HARDEE’S immediately of any breach of security or unauthorized use of your account. Although HARDEE’S will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of HARDEE’S or others due to such unauthorized use.

You agree not to use or launch any automated system, including without limitation, "robots," "spiders," "offline readers," etc., that accesses the Site in a manner that sends more request messages to the HARDEE’S servers in a given period of time than a human can reasonably produce in the same period by using a conventional online Web browser. Notwithstanding the foregoing, HARDEE’S grants the operators of public search engines permission to use spiders to copy materials from the Site for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. HARDEE’S reserves the right to revoke these exceptions either generally or in specific cases. You agree not to solicit, for commercial purposes, any users of the Site with respect to their User Submitted Content.
4. The customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website (Age of consent is mentioned as per the applicable law)

Indemnification

You agree to indemnify and hold HARDEE’S, its parents, subsidiaries, officers, employees and Site contractors and each of their officers, employees and agents harmless from any claims, damages and expenses, including reasonable attorneys' fees, related to your violation of these Terms, or any violations thereof by your dependents or which arises from the use of Submitted Content.

Hyperlinks

This HARDEE’S Site may link to sites not maintained by or related to HARDEE’S. Hypertext links are provided as a service to users and are not sponsored by or affiliated with this Site or HARDEE’S. HARDEE’S has not reviewed the sites hyperlinked to or from this Site and is not responsible for the content of any other site. These links are to be accessed at the user's own risk. HARDEE’S makes no representations or warranties about the content, completeness or accuracy of these links or the sites hyperlinked to or from this Site. Furthermore, HARDEE’S does not implicitly endorse third-party sites hyperlinked to or from this Site.

Governing Law and Jurisdiction

Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of Pakistan

Miscellaneous

These terms constitute the entire agreement between you and HARDEE’S and govern your use of the HARDEE’S Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and HARDEE’S with respect to the HARDEE’S Site and services. Both you and HARDEE’S acknowledge and agree that no partnership is formed, and neither you nor HARDEE’S has the power or the authority to obligate or bind the other.
The failure of HARDEE’S to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, the parties nevertheless agree that the court should endeavor to give effect to the parties' original intentions as reflected in the provision, and the other provisions of this Agreement shall remain in full force and effect.
The failure of HARDEE’S to comply with this Agreement because of an act of God, war, fire, riot, terrorism, earthquake, actions of official authorities or for any other reason beyond the reasonable control of HARDEE’S, shall not be deemed a breach of this Agreement. If HARDEE’S fails to act with respect to your breach or anyone else's breach on any occasion, HARDEE’S is not waiving its right to act with respect to future or similar breaches.
The headings in this Agreement are for your convenience and reference. These headings do not limit or affect this Agreement.
If any provision of these terms of use shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms of use and shall not affect the validity and enforceability of any remaining provisions.
This Agreement constitutes a binding agreement between you and HARDEE’S, and is accepted by you upon your use of the Site. This Agreement constitutes the entire agreement between you and HARDEE’S regarding the use of the Site and the features therein.
